myInkwell is an AI-powered platform that allows users to create personalized children's storybooks. The Service includes story generation, character design, illustration creation, page layout editing, and optional print ordering.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. By creating an account, you represent that you are a parent, legal guardian, or authorized adult creating storybooks on behalf of a child.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

5. Content Ownership and License

Your Content

You retain ownership of the original text, names, descriptions, and creative inputs you provide to the Service. By using the Service, you grant myInkwell a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you.

AI-Generated Content

Stories, illustrations, and other content generated by our AI are provided for your personal, non-commercial use. You may print, share, and gift books created through the Service. You may not resell AI-generated content as standalone assets (e.g., selling illustrations separately) or use it to train other AI models.

Our Content

The myInkwell platform, including its design, code, branding, and documentation, remains the property of myInkwell. You may not copy, modify, or distribute any part of the platform.

6. Acceptable Use

You agree not to use the Service to:

  • Create content that is harmful, abusive, obscene, or inappropriate for children
  • Generate content that infringes on the intellectual property rights of others
  • Attempt to circumvent security measures or access other users' data
  • Use automated tools to scrape, overload, or interfere with the Service
  • Violate any applicable laws or regulations

We reserve the right to remove content and suspend accounts that violate these guidelines.

7. AI Disclaimer

Content generated by AI may occasionally contain errors, inaccuracies, or unexpected results. While we strive for quality, we do not guarantee that all generated content will be free from imperfections. You are responsible for reviewing and editing your book before ordering a print copy.

AI-generated illustrations are created algorithmically and may vary in style and consistency. We continuously improve our generation pipeline but cannot guarantee specific artistic outcomes.

8. Payments and Orders

  • Print orders are processed through Stripe and fulfilled by Lulu.
  • Prices are displayed at checkout and include applicable taxes and shipping.
  • All sales are final once a print order has been submitted for production.
  • If there is a printing defect or shipping damage, contact us for a replacement.

9. Free and Paid Features

You may create stories and preview your book for free. A purchase is required to unlock the full book, download PDFs, and order printed copies. We reserve the right to modify pricing and feature availability with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, myInkwell and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or service interruptions.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service at our discretion if you violate these terms. Upon termination, your right to use the Service ceases, but provisions that by their nature should survive (e.g., ownership, liability limitations) will continue in effect.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised terms with an updated effective date. Your continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
